NAC Breda loses passport dispute case, Eredivisie campaign concludes on schedule

The court determined that NACs desire to rearrange a fixture does not inherently supersede the KNVBs priority to avoid substantial disruptions as the Eredivisie draws to a close, thereby upholding the KNVBs prior decision in the matter.

The governing body opted against permitting a rematch in order to safeguard the broader welfare of football in the Netherlands, a stance the court endorsed.

The judge noted that it is reasonable for the league organisers to prioritise the possible severe repercussions for the competition, which is approaching its end, over NACs wish to contest the fixture again.

133 possible rematches

NAC Breda initiated legal action against the KNVB and Go Ahead Eagles following their 6-0 defeat by the Eagles on 15 March. NAC claimed that Go Ahead Eagles forward Dean James, registered under Dutch status, was unfit to participate since he had relinquished his Dutch citizenship after acquiring Indonesian nationality.

In early April, the KNVB declared it would impose no sanctions on Go Ahead Eagles, while acknowledging Jamess ineligibility.

NAC Breda insisted on replaying the 6-0 defeat, a request that could have caused major issues for the Eredivisie, as director Marianne van Leeuwen explained to ESPN following a preliminary session last week. A favourable ruling for NAC Breda would have opened the door for 133 Eredivisie fixtures to require rematches, given that Ajax, Feyenoord, Telstar, FC Volendam, and Heracles Almelo had all notified the KNVB of their plans to pursue similar legal avenues.

NAC Breda offered a brief reaction to Mondays decision: An unfit participant featured in that encounter, prompting NAC to urge the national football body to examine the situation. NAC then pursued a legal reassessment of the league organisers choice to decline a rematch with Go Ahead Eagles, the club stated.

NAC intends to review the ruling thoroughly and consult with experts before issuing additional statements.
